SJC Holds LLC Managers May Be Personally Liable Under MA Wage Act

July 24, 2013 Leave a comment

The Massachusetts Supreme Judicial Court (“SJC”) recently ruled in Cook v. Patient EDU, LLC, et al. (SJC-11272) that language in the Massachusetts Wage Act imposing personal liability on officers and agents of a “corporation” applies equally to managers of a limited liability company (“LLC”). (SJC-11272), SJC’s decision and what this means for employers.
